TERMS AND CONDITIONS OF MEMBERSHIP
By becoming a member you acknowledge and agree to be bound by all of the following terms and conditions (“Terms”), our website Terms of use, our Privacy Policy, disclaimer, responsible gambling and any additional terms that may be applied to the membership and its facilities from time to time (collectively, the “Agreement”). If you do not agree to be bound by this Agreement, do not register for membership. MY ULTIMATE PUNTER (“The Company”) who operates the membership. MY ULTIMATE PUNTER reserves the right to modify or terminate the Mypunter.com membership or card at any time and in any manner, in whole or in part. You agree that you will review these terms and conditions periodically and that you are bound by this Agreement and any modifications we may make to it from time to time.
Membership
When joining Mypunter.com there are 3 types of membership.
Annual Membership: Valid from August 1 2017 to July 31st 2018 inclusive. After $49.95 payment, user is mailed a membership card to their nominated address (processing time may vary). This membership card allows the holder entry into public areas of Caulfield, Mornington, Bendigo and Sandown Racecourses on nominated racedays (excludes cup days). This type of membership also gives the user access to all tips & selections posted on MyPunter.com for the 2017/2018 racing season (ends 31/07/2018)
Tips & Selections Memberships: There are 2 Tips & Selections only memberships. These membership options give the member access to all MyPunter.com Tips and Selections for a selected period of time. The access duration options are: 24hrs OR 7 Days
Free Membership: Free members can access most of the site though only have limited access to our tips & selections. This type of membership has no time limit. FREE tips and selections are for selected race meetings only. (Nominated by mypunter.com)
Membership contd
On presentation of a valid MyPunter.com membership card (an annual member will receive free entry into public areas of Melbourne Racing Club venues (Caulfield, Sandown & Mornington Racing Venues) and Bendigo Jockey Club (excluding cup days). The member must adhere to all entry requirements including behavior and dress codes.
There are links below which have the MRC (known as the MELBOURNE RACING CLUB) and Bendigo (known as BENDIGO JOCKEY CLUB) full terms & conditions for their racing venues.
The Mypunter.com card will be shown upon entry and access will be granted at no charge to the member unless the member does not meet these terms and conditions.
Melbourne Racing Club | Bendigo Turf Club
The member agrees in accordance with the rules, regulations and policies established by the Racing Club Venue and upon entering agrees to abide by these conditions on entry. A Mypunter.com Member has no ownership interest in The Mypunter.com card, the individual properties or facilities of the participating venue, or income there from.
As a Mypunter.com member, you have the ability to participate at Mypunter.com events and or functions, subject to certain restrictions as outlined below. All Mypunter.com members must adhere to dress codes on certain events and may be turned away if this dress code is not adhered to. Members may also receive additional benefits and discounts, with other service providers participating in The Mypunter.com network from time to time.
The member agrees in accordance with the rules, regulations and policies established by the Racing Club Venue and upon entering agrees to abide by these conditions on entry. A Mypunter.com Member has no ownership interest in Mypunter.com, the individual properties or facilities of the participating venue, or income there from.
Mypunter.com Members who are a resident of Australia will receive MMS messaging for Mypunter Late Mail, Specials and other marketing and notices. The member when joining can refuse this feature and of which will not receive this benefit of MMS. However the member agrees to receive mms for notification of changes to the terms & conditions or other policies.
It is also a condition that all members upon joining Mypunter.com open a betting account with CrownBet of another affiliate bookmaker via the mypunter.com website. This is to be done via the Mypunter.com website. If the member joins not by website but in person they authorize Mypunter.com to register the member with the bookmaker of their choice and will be notified by email and or text that the registration has been done on their behalf.
Eligibility
To become a Member of Mypunter.com, you must: (a) Be at least 18 years of age as of the date of your registration for Mypunter.com card; and, (b) have the capacity to enter into a legally binding contract.
Mypunter.com membership is subject to this Agreement, as well as any policies and procedures that My Ultimate Punter and/or participating Racing Clubs may have, adopt or modify from time to time. Any failure to abide by this Agreement or any policies or procedures implemented by My Ultimate Punter and/or participating Racing clubs, any conduct detrimental to My Ultimate Punter and/or participating Racing clubs, any misrepresentation or fraudulent activities in connection with the use of Mypunter.com, or any failure to act in a manner consistent with federal, state, provincial, or local laws, regulations, or ordinances, may result, in addition to any rights or remedies available to My Ultimate Punter in law or equity, in the termination of your membership in The Mypunter.com Membership, as well as any other benefits earned in connection therewith, is My Ultimate Punter sole discretion.
Cancellation
My Ultimate Punter may terminate membership for cause at any time. A member who conducts him or herself in an unbecoming manner on the premises of one of the associated Racing clubs or who violates any rules or regulations of such Racing clubs, including dress code, or who fails to pay dues and charges, or violates any term of this agreement, may be suspended or expelled from The Mypunter.com membership program for cause.
It is understood and agreed that if My Ultimate Punter revokes membership privileges of Member with cause, or if Member resigns, no refund will be made. Termination of membership shall be a full and complete release of My Ultimate Punter from any and all liability, claims, demands, actions or cause of actions arising out of, or related to, the payment by Member of monthly or yearly dues or membership status.
Disclaimer & Limitation of Liability
MY ULTIMATE PUNTER MAKES NO WARRANTY OF ANY KIND REGARDING THE MYPUNTER.COM MEMBERSHIP, WHICH IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ANY REPRESENTATION OR WARRANTY THAT THE MYPUNTER.COM MEMBERSHIP WILL BE ERROR-FREE. MY ULTIMATE PUNTER FURTHER DISCLAIMS ANY WARRANTY AS TO THE ACCURACY, COMPLETENESS AND TIMELINESS OF ANY CONTENT OR INFORMATION DISTRIBUTED WITH RESPECT TO MYPUNTER.COM. WE EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS, INCLUDING IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THIS WARRANTY DISCLAIMER MAY BE LIMITED IN ITS APPLICABILITY TO YOU. IN NO EVENT SHALL MY ULTIMATE PUNTER BE LIABLE HEREUNDER FOR INCIDENTAL, SPECIAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES EVEN IF ADVISED IN ADVANCE OF THE POSSIBILITY FOR SUCH DAMAGES.
Modification
We reserve the right at all times to discontinue or modify any part of this Agreement, as we deem necessary or desirable. Additionally, we reserve the right at all times to add or remove Mypunter.com membership services You specifically agree to provide and maintain a valid e-mail address and to keep My Ultimate Punter informed of any changes to your e-mail address. Any changes to this Agreement will be effective upon the earlier of our dispatch of an e-mail notice to you or our posting of notice of the changes on our website. We suggest that you review these Terms from time to time to ensure that you are aware of any updates we make to these Terms. Your participation in the Mypunter membership after we update the Agreement will constitute acceptance of the modified Agreement.
Miscellaneous
Member agrees to indemnify and hold My Ultimate Punter harmless from any loss (including legal fees) or liability for personal injury or property damage, resulting from the acts of the Member arising out of the use of the membership.
If any provision of these terms and conditions is held invalid, the remainder shall not be affected thereby if such remainder would then continue to conform to the terms and requirements of applicable law.
These terms and conditions shall be governed by and construed in accordance with the laws of the State of Victoria.
In the event that Member or My Ultimate Punter cannot resolve a dispute arising out these terms and conditions and if the dispute cannot be settled through negotiation, the Parties agree first to try in good faith to settle the dispute by mediation before resorting to arbitration, litigation, or some other dispute resolution procedure. A written request shall be made by one party to the other party to initiate the resolution process. The Parties further agree that these terms and conditions shall remain in effect until such disputes are resolved or settled by the appropriate judicial process and at all times confidential between both parties
